General Risk Disclosure. BUYER ACKNOWLEDGES AND AGREES THAT THE PURCHASE OF A PRESALE POSITION IN A DEVELOPMENTAL AIRCRAFT INVOLVES SUBSTANTIAL RISKS, INCLUDING BUT NOT LIMITED TO THE FOLLOWING: (a) Technology Risk: The SkyStryder VTOL Aircraft is a developmental aircraft. The technology, design, and engineering underlying the Aircraft are not yet fully proven in commercial operation and may require significant additional development. (b) Production Risk: There is no guarantee that the Aircraft will enter full-scale production. Seller may determine, at its sole discretion, that production is not commercially viable or technically feasible. (c) Timeline Risk: Actual delivery of the Aircraft may be significantly delayed beyond the Minimum Delivery Period, or may not occur at all, due to factors including regulatory approvals, engineering challenges, or business conditions. (d) Financial Risk: Buyer’s Presale Credit of $8,000.00 is non-refundable. If the Aircraft is never delivered, or if Buyer elects not to proceed, the Presale Credit will not be returned. (e) Specification Risk: Final Aircraft specifications, performance characteristics, payload capacity, range, avionics, and other features may differ materially from current marketing or promotional materials. Seller reserves the right to modify any and all specifications prior to final production. (f) Market Risk: The commercial VTOL aviation market is nascent and rapidly evolving. Regulatory frameworks, infrastructure, and market demand are uncertain and may affect the Aircraft’s ultimate utility, value, or resale potential. (g) Certification Risk: There is no guarantee that the SkyStryder VTOL Aircraft will receive FAA type certification or any other required regulatory certification. See Section 5 for full terms. 4.2 Buyer Acknowledgment. BUYER REPRESENTS THAT BUYER HAS READ, UNDERSTOOD, AND VOLUNTARILY ACCEPTED ALL RISKS DESCRIBED IN THIS SECTION AND IS ENTERING INTO THIS AGREEMENT WITH FULL KNOWLEDGE OF SUCH RISKS.
